Education dept yet to set aside transfer & posting of 2 officials

PESHAWAR: The Khyber Pakhtunkhwa Education Department is yet to set aside the transfer and posting of the district education officers, Peshawar and Upper Dir from teaching cadre to management cadre despite the orders given by Peshawar High Court on October 22, this year.The court, while allowing the writ petition filed by Iftikhar Khan and another petitioner, had directed the authorities concerned to set aside the transfer of the two officers.The court also directed the authorities concerned to strictly observe the law and policy by not adjusting teaching cadre staff in management cadre. However, more than a month has passed, but the authorities have not yet implemented the orders. The petitioners had sought issuance of an appropriate order against the notification dated March 8, 2019, whereby two officers from teaching cadre had been transferred and posted to management/administrative cadre as District Education Officers, Peshawar and Upper Dir.The petitioners stated that the transfers and postings of the two officers were illegal without lawful authority and having been issued in absolute disregard of the law, judgments/orders passed by courts through a number of writ petitions and thus liable to be struck down.The National Education Policy 2009 and Elementary and Secondary Education Department had separated management cadre from teaching cadre vide notification dated May 4, 2009, and recently in view of judgment of the Peshawar High Court dated January 11, 2018, delivered in a petition respondents have also framed service rules for management cadre which have been duly notified. But in spite of that the two officers, who belonged to teaching cadre have been adjusted in the management cadre, the petition stated.
